本文在对保赔保险合同的成立、法律关系、法律性质、保赔保险合同的转让、续订、终止及其法律后果、保赔保险合同的索赔和理赔、保赔保险合同纠纷的解决及存在的问题、我国保赔保险合同的发展现状、保赔保险对海上保险立法的影响等方面进行阐述、评价和综合、比较分析的基础上，提出了补充修改我国现有海上保险立法，在其中增设保赔保险合同部分规定的建议，并就补充修改的体例、形式和内容作出了设计。
